California Woman Awarded $12M in Lawsuit Against J&J for Carcinogenic Talc Products

In a recent development in the ongoing story of Johnson & Johnson (J&J) talcum powder products causing various forms of cancer, a California jury recently ruled out of favor of the corporation and co-defendant Colgate-Palmolive (Colgate). The plaintiff, a woman dying of terminal mesothelioma, was awarded $12 million by the jury, who concluded that regular use of J&J talcum powder products “more likely than not” caused her cancer growth. This jury verdict is noteworthy in that it took the jury five full days of deliberation to reach a conclusion, making it more difficult for the defendants to claim jury bias or a misunderstanding of the evidence.

J&J and Colgate were both accused of:

  • Negligence
  • Design defect
  • Failure to warn and concealment of facts

The jury did not conclude uniformly that the companies had acted with any malice, nor did it decide that J&J had intentionally misrepresented the safety of its products. For years, the company has known that asbestos traces can be found in talc powder, and that asbestos has been linked to increased risks of mesothelioma, ovarian cancer, and other diseases.

All within the last 12 months, Johnson & Johnson has lost two other jury trials brought forth on the same allegations that talc powder products had caused cancerous growths in consumers with regular use. Both multimillion dollar verdicts were challenged by J&J, but judges have not yielded and the verdicts currently still stand. Thousands of other cases are forming or are in the midst of trials across the country, and a handful of others have also ended with plaintiff success.
