Tim West
About
Kansas City Product Liability Attorney
Tim had never met a lawyer before he started law school, but was committed to making a difference and being the best possible lawyer. Graduating at the top of his class, serving as the Managing Editor of the Law Review, Chief Justice of the Honor Court and a Legal Research and Writing Teaching Assistant propelled him into working at the largest law firm in Kansas City doing product liability defense for large companies. After a few years and some trial experience, he decided that he needed a more diverse practice that would permit him to try more cases and experience other areas of the law. That desire and a well-timed federal court trial lead him to receive an offer from the top business litigation firm in Kansas City. For the next 13 years, Tim represented a collection of plaintiffs and defendants in state and federal court proceedings across the country. These clients included very large companies and local individuals. Tim’s representation of these clients resulted in seven-figure plaintiffs verdicts on one-hand and complete defense verdicts on the other. Regardless of the client, Tim has been able to obtain exceptional results in the form of jury verdicts and settlements. From day one, Tim has believed that every single person deserves the very best representation possible and has striven to provide that each and every one of his clients.
It was by great luck that Tim received a case referred to him by another firm that he ended up opposing Bertram & Graf in a complex products liability case regarding novel liability theories. That case created the mutual respect between Tim and Scott and Ben Bertram that lead him to his current position as a partner in the firm. Tim has maintained his business litigation practice and continues to assist individuals in contract and business disputes of all sorts. While a trial lawyer at heart, Tim still believes that the best outcome in most business disputes is a business solution. He strives to obtain that for his clients and minimize the costs associated with litigation.
Being at Bertram & Graf, has also allowed Tim to returned to his first love—products liability. Currently, in addition to his myriad of business litigation disputes, Tim is litigating 3M earplug cases, Opioid cases on behalf of local governments and traumatic brain injury cases. Tim is committed to each of his clients cases and knows that each case carries with it special challenges and opportunities that require individualized attention.
Tim counts it as a blessing that he is one of few lawyers that has been able to represent both plaintiffs and defendants in large class actions. Currently, Tim is focusing his class action practice on shareholder disputes and violations of the Fair Labor Standards Act, which protects employees from having to work off the clock and other violations that keep employees from being paid for all the hours they worked.
